A buzz phrase which has become synonymous with accident claims and compensation claims is the ‘no win no fee’. This slogan or claim has been around for around 12 years since 1998 when the government decided the UK treasury was getting swamped with the rising cost in legal aid.
What is no win, no fee? Well it does what it says on the tin really, if you fail to win your accident claim the solicitor in turn does not get paid. The solicitor may seem to be getting a bad deal especially if they lose but this is not the case, if they win they are able to claim all their expenses off the opponents. So if the solicitor finds you have a strong case the likelihood they will be really willing to work for free so that you can then win the claim and they get paid.
Things to take into account
Some solicitors may ask for a fee up front with the premise that once you win you can be paid back by the court. The problem with this is that the court will only pay back what they consider to be a reasonable fee.
Make sure you are covered because have you ever wondered what happens if you lose the claim? If you lose the claim you may be entitled to pay the opposition’s solicitors’ fees so remember to ask and find out in detail what happens in the event of a loss! Good solicitors often have insurance policies which cover this event, if the solicitor says they do not have this cover it may be wise to pester them to get it as it isn’t that expensive and will save you money!
The biggest advantages of going with no win no fee claims is that when you win you receive 100 per cent of the fee won in court so none of it will be affected by the solicitor’s fee and other services which you have used as the opposition are entitled to pay it.
