Medical Lawsuit Explanations
When people think of a medical lawsuit, many think of malpractice lawsuits where a person or group of people have filed a case against a doctor or maybe a healthcare establishment. Yet, there are other types of cases where people’s health has been compromised, and cases have been filed. This article will attempt to explain several different types of medical lawsuits.
Medical Lawsuits May Include (yet are not limited to):
Medical malpractice lawsuit: This type is the one most people are aware of. They usually involve “professional” negligence on the part of a health care provider like a doctor or even a nurse. The place where the negligence happened may be held accountable as well. The negligence would cause some type of injury or death of a patient. The case may be filed by the person it happened to or by a family member.
An example would be where a doctor amputates the wrong limb. Although it may sound far-fetched, this type of negligence does occur.
A Drug Lawsuit: This type may involve drugs both over the counter or prescription that have caused harm to a number people. Usually, the health problem is experienced in the same way by these people and can be directly linked to the particular drug. The case may be filed by the person it happened to or by a family member. It could also be a class action suit or a personal one.
An example would be a Paxil or Effexor Lawsuit where Paxil or Effexor (an anti-depressant), being linked to several types of birth defects of babies born to mothers who took the antidepressant during their pregnancy.
Toxic Material Exposure Lawsuit: This particular type of case usually involves personal injury or harm to one’s health through exposure (long term or short term) to known (and sometimes unknown at the time) hazardous materials. The exposure could be happening while one is at work or even in one’s home (the hazardous materials may be within the home’s construction materials or even consumer goods). The health problems would need to be proven to be directly linked to the exposure. Usually a number of people experience similar health problems that are linked to the particular type of toxic material exposure.
A very well known example would be exposure to Asbestos (a known hazardous material), many times through the person’s workplace, school, home or even old consumer goods. One of the side-effect and health problems associated with this type of exposure are lung problems and lung cancer called “Mesothelioma.”
A Chemical Exposure Lawsuit: This type of case usually involves personal injury or harm to one’s health through exposure (long term or short term) to known (and sometimes unknown at the time) hazardous chemicals. The exposure could be happening while one is at work or even in one’s home (the chemicals may be within the home’s construction materials). The health problems would need to be proven to be directly linked to the exposure. Usually a number of people experience similar health problems that are linked to the particular type of chemical exposure.
An Example — not well known, yet beginning to show up more, is Myelodysplastic Syndrome (MDS) a rare blood disorder. It is being found that prolonged exposure to the chemical Benzene can be linked to MDS. Prolonged exposure to Benzene can happen in industrial work settings. In addition, prior to being found toxic, Benzene could be found in a number of consumer goods.
Although the government has, and is, requiring reduction of this chemical in the workplace, many industries still have workers exposed. Some industries where Benzene exposure may occur are paint, paper, pesticides, leather, rubber, and plastics workplaces. Benzene is also used in oil refineries and in petroleum product manufacturing.
Medical Device Lawsuits: This type of case may include a type of medical device that causes harm or causes undue distress to the patient who uses it, either through surgery or otherwise.
An example would be a hip replacement device recall. Some people who received the ASR Hip Resurfacing System and ASR XL Acetabular System (data showed 1 in 8 people experienced device failure) are having to have a second hip replacement surgery. The company that made it has reported that 93,000 of the recalled hip replacement models have already been surgically implanted into patients.
